Faculty ADA Accommodation FAQs

The Americans with Disability Act (ADA) is a civil rights law designed to remove barriers which prevent qualified individuals with disabilities from enjoying the same employment opportunities that are available to persons with disabilities. The law is regulated and enforced by the U.S. Equal Opportunity Commission (EEOC).

California statute expands qualified disabilities as those which include mental or physical conditions that “limit” a major life activity rather than “substantially limit.”  The Department of Fair Employment and Housing (FEHA) regulates the California statute regarding disabilities.

 

 

 

This document outlines the steps for requesting and processing medical accommodations in the workplace, in accordance with the Americans with Disabilities Act (ADA) and applicable university policy.

  1. Employee Inquiry or Notification - The employee notifies their Chair or appropriate department head and or Faculty Affairs of a need for accommodation, either verbally or in writing. Alternatively, Faculty Affairs may initiate the process if aware of a potential need.
  2. Provide Medical Accommodation Forms - Faculty Affairs provides the necessary forms, including a medical provider questionnaire and an optional employee request form.
  3. Employee Submits Documentation - The employee completes and returns the forms with supporting medical documentation to AA-FacultyLOA@csulb.edu
  4. Employer Reviews Documentation - Faculty Affairs reviews the documentation to determine whether the employee has a qualifying condition and to understand any limitations.
  5. Interactive Process Meeting - An interactive meeting is scheduled between Faculty Affairs, the appropriate department/college management and the employee to explore reasonable accommodation.
  6. Determine and Implement Accommodation - Faculty Affairs identifies and implements effective, reasonable accommodation and provides written confirmation to the employee.
  7. Monitor and Adjust as Needed - The accommodation is periodically reviewed and adjusted as necessary based on changes in duties or medical conditions.
